Commercial Litigation

The focus of Mr. Buchanan's litigation practice is the representation of subcontractors and suppliers on mechanic and materialmen lien claims, surety bond claims and trust fund claims. For many clients he prepares and record mechanic's and materialmen's lien affidavits.

Mr. Buchanan also represent subcontractors and suppliers in bankruptcy court, enforcing trust fund claims and defending preference actions.

Mr. Buchanan represents landlords and tenants in commercial lease disputes and evictions.

Mr. Buchanan has extensive litigation experience representing clients in the collection of accounts receivable, the enforcement of judgments and the domestication and enforcement of foreign judgments in both state and federal court.

Recovered and collected judgment for supplier on payment bond against surety claiming defective notice to bankrupt general contractor
Successfully defended motion for summary judgment against supplier and negoitated favorable settlement with owner claiming defective legal description in lien affidavit
Negotiated favorable settlement for supplier for statutory retainage against owner claiming lien affidavit filed late
Collected 100% of supplier's claim against subsequent owner of property
Recoverd favorable settlement on behalf of supplier against subcontractor claiming purchase of material not authorized and material stolen by employee
Successfuly defended supplier against preferential transfer claim brought by subcontractor's bankruptcy trustee
Collected funds owing to supplier from owner despite general contractor's bankruptcy on basis of Texas trust fund statute

Mr. Buchanan's business practice focuses on the creation, conversion and termination of corporations, limited liability companies, general partnerships, limited partnerships, professional corporations, professional associations and not-for-profit corporations.

Estate Planning

Mr. Buchanan's estate planning practice focuses on the represenation of individuals and married couples with small to medium sized estates. He can assist you with the preparation of simple and tax-planned wills, revocable trusts, durable powers of attorney, medical powers of attorney, physicians directives (living wills).
